WEBSITE AND DIGITAL SERVICES TERMS OF USE 1. PARTIES AND SCOPE These Terms govern digital services provided by K.r.b do Carmo da Luz Outras Atividades Profissionais, trade name Acustica Lagos, Brazilian CNPJ 20.172.919/0001-70, established at Rua Quatorze, 736, Reserva do Pero, Cabo Frio, Rio de Janeiro, ZIP 28921-665, Brazil, including the website, accounts, licensing, support, web modules and hybrid features of the CRYSOUND/SONARA ecosystem. 2. ACCOUNT AND CREDENTIALS Users must provide accurate information, protect credentials and control who uses their account, computer and associated equipment. Activities performed with valid credentials may be logged for security, audit, licensing and support. 3. HYBRID MODEL AND LOCAL DATA SONARA uses a hybrid, local-first architecture. Measurements, projects, acoustic files, technical evidence and other work data remain by default on the user’s computer, under the user’s responsibility for storage, backup, retention and continuity. Acustica Lagos does not automatically receive or keep a complete copy of those data. Limited data enter the online environment only when required for the account and service or when the user knowingly activates a function that requires transmission, such as an authorized transfer between SONARA Connect PC and SONARA Live Using SONARA does not transfer to Acustica Lagos the duty to preserve the user’s entire technical archive. The user is responsible for storage, integrity, organization, backup and continuity of local files. 4. ONLINE FEATURES CHOSEN BY THE USER When a user activates a feature that depends on the online environment, the user authorizes only the processing required to perform that feature. Transfers between SONARA Connect PC and SONARA Live, when used, are deliberate and specific operations. They do not authorize automatic full synchronization or permanent storage of all content on the PC. 5. LICENSES, MODULES AND COMMERCIAL CONDITIONS Plans, modules, terms, prices and limits are those disclosed in the applicable purchase flow and commercial account records. The license grants a right of use within the contracted scope and does not transfer ownership of software, trademarks, source code or proprietary technology. 6. PROFESSIONAL USE AND RESULTS SONARA assists acoustic processing, calculation, analysis and documentation. The user remains responsible for input data, measurement procedures, interpretation, review and professional decisions. Features related to technical standards do not by themselves constitute accreditation, certification or a guarantee of conformity of a laboratory, measurement or report. 7. PRIVACY AND PERSONAL DATA Purposes: manage accounts, authentication, licenses and modules; process commercial relationships and billing; provide support; record events required for security, audit and integrity; and execute online features that the user chooses to activate, including authorized transfers between SONARA Connect PC and SONARA Live Legal bases: performance of a contract and pre-contractual procedures; compliance with legal or regulatory obligations where applicable; exercise of legal rights; legitimate interests strictly necessary for security, fraud prevention and operation of the service, subject to necessity and impact assessment; and consent where the operation requires a specific manifestation by the data subject Processing follows the current Privacy Policy. Local technical data are not automatically incorporated into the online environment. Only content required for the feature chosen by the user may be transmitted when that feature requires communication with the service. 8. SECURITY AND RESPONSIBILITIES BY LAYER Account- and role-based access control, authentication and session protection, access and security event logging, audit trails, legal-document versioning and hashes, privilege segregation, updates controlled through the Update Manager and integrity controls. Security of technical files that remain on the PC also depends on safeguards adopted by the user on the device, operating system, network and backup routine Acustica Lagos is responsible for online components it administers. The user is responsible for physical and logical security of the PC, operating system, network, credentials, local files and backups. 9. RETENTION AND BACKUP Technical files kept on the computer follow criteria defined by the user, who is responsible for custody, backup and deletion. In the online environment, account, licensing, transaction, support, security, audit, acceptance and operational records are retained only for a period compatible with service delivery, legal obligations, security, audit and exercise of legal rights. Data transmitted through a hybrid function are processed for the period necessary to perform the chosen operation and according to the controls available in the service Acustica Lagos does not undertake to back up files that remain exclusively on the PC. Before updates, computer maintenance or critical operations, the user should maintain suitable copies of files essential to professional activity. 10. USE RESTRICTIONS The service must not be used for fraud, rights violations, unauthorized access, improper bypass of licensing controls, malware distribution or falsification of technical evidence. Mandatory statutory rights remain unaffected. 11. UPDATES AND AVAILABILITY The software may receive security fixes, improvements, standards-related adjustments and compatibility changes. Online services depend on internet access and operational infrastructure and may undergo maintenance. Nothing in these Terms converts the service into a universal repository or a guarantee of indefinite preservation of local technical files. 12. SUPPORT Support is available through the official Acustica Lagos service and support channels made available on the website and in the authenticated area of the system. The user may voluntarily provide specific information necessary to diagnose an issue, limited to the support purpose. 13. SUSPENSION AND TERMINATION Online access or licenses may be suspended or terminated upon expiration, non-payment under applicable commercial terms, fraud, security risk, legal order or material breach. Online data controlled by Acustica Lagos follow legal and operational retention criteria; local files remain under the user’s responsibility. 14. CHANGES AND ACCEPTANCE Published versions remain immutable and are identified by version and hash. Material changes create a new version and may require renewed acceptance. 15. LAW Applicable rules: laws of the Federative Republic of Brazil. Where a choice of forum is legally valid, Cabo Frio, Rio de Janeiro, Brazil is indicated, without excluding mandatory jurisdiction or any forum guaranteed by applicable mandatory law
